Terms of Service

These terms form a contract between you and Progtic Consultant Inc. ("Progtic", "we"), the company that publishes the Kumaa app (kumaa.app). By creating an account or continuing to use Kumaa, you accept these terms. If you use Kumaa on behalf of an organization, you represent that you have the authority to bind it; otherwise, you represent that you meet the legal age required in your country.

1. The service

Kumaa lets you record short speech clips and get an automatic transcription plus AI-generated feedback (verbal tics, clarity, pacing, exercises, goals, badges). Kumaa is a personal training tool, not a diagnostic, speech-therapy, or professional advisory service.

2. Your account

• You must provide accurate information and keep it up to date.
• You are responsible for keeping your credentials confidential and for any activity carried out from your account.

3. Acceptable use

You agree not to:

• use Kumaa for illegal or fraudulent purposes, or to send spam;
• upload recordings of other people without their consent, or content that infringes third-party rights;
• post content that is unlawful, hateful, harassing, defamatory, or sexually explicit;
• compromise the security of the service: malware, penetration testing, circumventing technical limits, automated scraping, or reverse engineering;
• resell, redistribute, or share your access outside your own subscription.

4. AI-generated content

• You are responsible for what you record, for how you use the results, and for verifying their accuracy.
• You must hold the necessary rights to any content you submit for analysis.
• AI-generated results may be inaccurate or incomplete. They do not replace the advice of a professional (medical, speech-language, legal, or financial).
• You retain the rights to your recordings. We grant you the right to use the resulting analyses for your personal or professional use.
• We may filter, refuse, remove, or restrict content or output, and suspend an account in case of abuse. A rights holder may report infringing content to the address below; repeated infringements will lead to account closure.

5. Intellectual property

Progtic Consultant Inc. retains all rights to Kumaa: software, interface designs, documentation, trademarks, and graphic elements. We grant you a limited, non-exclusive, non-transferable right of use, within the bounds of your chosen plan.

6. Service level

We do our best to keep Kumaa available, but we do not guarantee uninterrupted or error-free operation. To the extent permitted by law, all implied warranties (merchantability, fitness for a particular purpose) are excluded.

7. Payments and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles all customer-service requests and manages returns.

Payment, billing, tax, renewal, cancellation, and refund terms are governed by Paddle's buyer terms. See also our refund policy.

8. Suspension and termination

We may suspend or terminate your access in case of a material breach of these terms, non-payment, a risk of fraud or a security risk, or repeated or serious violations of our usage rules. You may stop using Kumaa at any time. Once your access ends, you have 30 days to export your data from the settings, after which it may be deleted.

9. Liability

To the extent permitted by law, our total liability is limited to the amounts you paid during the 12 months preceding the event. We exclude indirect, consequential, or special damages (loss of profits, data, or reputation). No limitation applies in case of fraud, death, or personal injury.

You will indemnify us against claims arising from your content, unlawful use of the service, or a breach of these terms.

10. Miscellaneous

• Governing law: the laws of the province of Quebec and of Canada, with competent courts in Montreal, subject to any mandatory rights of your country of residence.
• You may not assign this contract without our consent; we may assign it as part of a merger or acquisition.
• Force majeure: our obligations are suspended during events beyond our reasonable control.
• We may amend these terms; significant changes will be announced in the app or by email.
